1. Not a Medical Device
Prescribe AI is a documentation and productivity tool designed to assist licensed medical practitioners with prescription writing. It is:
- NOT a medical device as defined by the Central Drugs Standard Control Organisation (CDSCO) or any regulatory authority
- NOT a diagnostic tool
- NOT a clinical decision support system
- NOT a substitute for medical education, training, or clinical judgement
2. AI Limitations
Prescribe AI uses artificial intelligence for voice transcription and data extraction. AI technology has inherent limitations:
- Transcription errors: Voice-to-text conversion may mishear drug names, dosages, or medical terms, especially in noisy environments or with unfamiliar accents
- Extraction errors: The AI may incorrectly categorise, misinterpret, or omit information from the doctor's dictation
- Drug name confusion: Similar-sounding medications (e.g., Losartan vs Lisinopril) may be incorrectly transcribed
- Dosage errors: Numerical values in dosages may be misheard or misplaced
- No drug interaction checks: The system does not verify drug-drug interactions, contraindications, or allergies
- No dosage validation: The system does not verify whether a dosage is within safe therapeutic ranges
Every AI-generated prescription is a DRAFT. The treating physician MUST review and verify all content — including drug names, dosages, frequencies, and instructions — before approving or sharing the prescription with the patient.
3. Doctor's Sole Responsibility
The prescribing doctor is solely and entirely responsible for:
- All clinical decisions, diagnoses, and treatment plans
- Verifying the accuracy and completeness of every prescription generated by the app
- Checking drug interactions, contraindications, allergies, and appropriate dosages
- Ensuring prescriptions comply with all applicable regulations, including the Drugs and Cosmetics Act, 1940 and NDPS Act, 1985
- Obtaining informed consent from patients
- Maintaining proper medical records as required by the Indian Medical Council regulations
4. For Patients
If you are a patient who has received a prescription generated through Prescribe AI:
- This prescription was written and approved by your doctor, not by AI
- Prescribe AI only assisted your doctor in documenting the prescription
- All medical decisions were made by your treating physician
- If you have questions about your prescription, please contact your doctor directly
- Do not alter your medication without consulting your doctor
5. No Warranty
Prescribe AI makes no representations or warranties regarding:
- The accuracy, reliability, or completeness of AI-generated transcriptions or extractions
- The suitability of the tool for any specific medical specialty or clinical scenario
- Uninterrupted or error-free operation of the Service
- Compatibility with all medical terminology, accents, or languages
6. Limitation of Liability
To the maximum extent permitted by Indian law:
- Prescribe AI shall not be liable for any patient injury, adverse outcome, or death arising from reliance on AI-generated content
- Prescribe AI shall not be liable for any malpractice claims, regulatory actions, or legal proceedings against the prescribing doctor
- The doctor agrees to indemnify Prescribe AI against any claims arising from prescriptions generated using the Service
7. Regulatory Compliance
Prescribe AI is designed to support compliance with Indian medical regulations but does not guarantee compliance. Doctors must independently ensure that their use of the Service complies with:
- Indian Medical Council (Professional Conduct, Etiquette and Ethics) Regulations, 2002
- Drugs and Cosmetics Act, 1940
- Narcotic Drugs and Psychotropic Substances Act, 1985
- Information Technology Act, 2000
- Telemedicine Practice Guidelines, 2020 (if applicable)
- Any state-specific medical practice regulations
