Terms & Conditions

These Terms and Conditions ("Terms") govern your use of the Prescribe AI mobile application, website, and related services (collectively, the "Service") operated by NILSA Enterprises, a sole proprietorship based in New Delhi, India, under the trademark "Prescribe AI™" ("we", "our", "us"). By accessing or using the Service, you agree to be bound by these Terms.

1. Eligibility

The Service is intended exclusively for use by registered medical practitioners in India. By creating an account, you represent and warrant that:

• You are a qualified medical professional legally permitted to practice medicine and issue prescriptions in India.
• You are at least 18 years old and capable of entering into a binding contract.
• All information you provide during registration is accurate and current.

We reserve the right to suspend or terminate accounts that do not meet these eligibility criteria.

2. The Service

Prescribe AI is a software tool that converts voice or text input into structured prescription data and generates PDF prescriptions on the doctor's letterhead. The Service is intended to assist medical practitioners with documentation — it does not replace medical judgment.

You acknowledge and agree that:

• All clinical decisions, diagnoses, and prescriptions remain solely your professional responsibility.
• You will independently review every AI-generated output for accuracy before issuing it to a patient.
• Prescribe AI is not a medical device under Indian or international regulations.

3. Account & Security

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at support@prescribedose.com if you suspect any unauthorized use.

4. Credits, Subscriptions & Payment

• Free Trial: New users receive 14 days of unlimited consultations (capped at 30 per day to prevent abuse).
• Subscriptions: Recurring monthly or annual plans. Credits reset each billing cycle; unused subscription credits do not carry over.
• Top-Up Packs: One-time credit purchases that never expire.
• Billing: All payments are processed through Razorpay. By subscribing, you authorize recurring charges to your chosen payment method until you cancel.
• Pricing changes: We may change pricing with at least 30 days' notice. Existing subscriptions complete their current cycle at the original price.

5. Cancellation & Refunds

You may cancel a subscription at any time from the app's billing section. Cancellation stops future renewals; you retain access until the end of the current billing cycle. Refunds are governed by our Refund Policy.

6. Patient Data & Confidentiality

You retain ownership of all patient data you enter into the Service. We process this data solely on your behalf as a data processor under the DPDP Act, 2023. Detailed handling is described in our Privacy Policy.

You are responsible for obtaining all necessary patient consents before entering their personal or medical data into the Service.

7. Acceptable Use

You agree NOT to:

• Use the Service for any unlawful purpose or in violation of medical ethics regulations.
• Attempt to reverse-engineer, decompile, or extract source code from the Service.
• Share your account with unlicensed individuals.
• Use automated bots or scrapers to interact with the Service.
• Upload content that infringes third-party intellectual property rights.

8. Intellectual Property

The Service, including all software, branding, designs, and content (excluding patient data you enter), is owned by NILSA Enterprises. "Prescribe AI" is a trademark of NILSA Enterprises. All content is protected by Indian copyright and trademark laws.

9. Disclaimers & Limitation of Liability

The Service is provided "as is" and "as available". To the maximum extent permitted by law:

• We make no warranty that the AI transcription or extraction is 100% accurate. You must verify all output before clinical use.
• We are not liable for any clinical harm, misdiagnosis, or treatment outcome arising from your use of the Service.
• Our total aggregate liability under these Terms shall not exceed the amount you paid us in the preceding 12 months.

10. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from (a) your use of the Service, (b) your violation of these Terms, or (c) your violation of any third-party rights, including patient privacy.

11. Termination

We may suspend or terminate your account if you breach these Terms, engage in fraudulent activity, or fail to pay. Upon termination, your right to use the Service ends immediately, but you may request data export within 30 days.

12. Changes to Terms

We may update these Terms from time to time. Material changes will be notified via in-app banner or email at least 14 days before they take effect. Continued use after that date constitutes acceptance.

13. Governing Law & Jurisdiction

These Terms are governed by the laws of India. Any dispute shall be subject to the exclusive jurisdiction of the courts located in the city of our registered business address.
